By entering this facility you waive all liability the City and its officers, agents and employees may have to you and release the City and its officers, agents and employees from all liability arising out of or in connection with: a. any event which may occur while you are present at the Centre; or b. any event which results in any loss or damage to property; except if the event, loss or damage is caused by the negligence of the City or its officers, agents or employees or a breach of the Australian Consumer Law.

By entering this facility you waive all liability the City and its officers, agents and employees may have to you and release the City and its officers, agents and employees from all liability arising out of or in connection with any injury (including death) being suffered or occasioned to you or any person in your care and control except: a. if the accident, injury or loss is caused by the City’s negligence; or b. in relation to claims for significant personal injury suffered by a person that is caused by the reckless conduct (as defined in section 139A of the Competition and Consumer Act 2010) of the City and its officers, agents and employees.

You acknowledge that while every attempt is made to ensure that our facilities and services are safe, there are some significant and inherent risks involved in your use of the facilities and services which may result in injury, permanent disability or death. You assume all such risks, and agree that you are attending and using the Facilities and Services voluntarily and entirely at your own risk.

I acknowledge and agree that this Waiver of Liability will be attached to my Swan Active profile, is ongoing and in effect for each casual admission to a Swan Active gym or group fitness class.

I indicate that I have read and understand the Waiver of Liability. I am aware that this is a waiver and a release of liability and I voluntarily agree to its terms.
